User Content and Rights

Ownership of Your Content: We do not claim ownership of the Content you submit to our Service. You retain all ownership rights in your Content.

This license exists only for the duration necessary to provide the Service to you.

Ownership of Generated Audio: The Generated Audio produced by our Service from your Content is your property, subject to payment of applicable fees and compliance with these Terms.

User Representations and Warranties: You represent and warrant that:

  • You own or have the necessary rights, licenses, consents, and permissions to use and authorize us to use your Content as necessary to provide the Service.
  • Your Content does not and will not infringe, violate, or misappropriate any third-party right, including any copyright, trademark, patent, trade secret, moral right, privacy right, right of publicity, or any other intellectual property or proprietary right.
  • Your Content does not violate any applicable law or regulation.

Acceptable Use

When using our Service, you agree not to:

  • Use the Service in any way that violates any applicable law or regulation.
  • Upload Content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.
  • Upload Content that infringes upon any patent, trademark, trade secret, copyright, or other intellectual property rights of any party.
  • Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Service, the server on which the Service is stored, or any server, computer, or database connected to the Service.
  • Use the Service to store or transmit viruses, worms, or other material designed to interrupt, destroy, or limit the functionality of any computer software or hardware.

Payment Terms

Payment: Payment for our Service is made through our authorized payment processors. By providing payment information, you represent and warrant that you are authorized to use the designated payment method.

Refunds: Our refund policy is as follows:

  • For significant technical issues that render substantial portions of the Generated Audio unusable, we may offer a full refund at our discretion.
  • For minor issues or specific passages that need improvement, we provide free regeneration of those sections.
  • No refunds are provided for subjective preferences once the full Generated Audio has been delivered.

Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Page & Pitch and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.

Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including, without limitation, if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.

Limitation of Liability

To the maximum extent permitted by law, in no event shall Page & Pitch, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Service;
  • Any conduct or content of any third party on the Service;
  • Any content obtained from the Service; and
  • Unauthorized access, use, or alteration of your transmissions or content;

Whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

Page & Pitch does not warrant that a) the Service will function uninterrupted, secure, or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet your requirements.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

Changes to These Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms on this page and updating the "Last Updated" date.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
